Abstract

It is now widely accepted that the enactment of Directive 91/440/EEC on Community Railways has posed a major challenge to the EU as regards the free movement of people and goods. Additionally, the need to split the management of rail infrastructures and the operation of transport services, as well as guaranteeing interoperability, has been materialised in terms of specific demands for the different Member States. This report is mainly aimed at analysing the Spanish case, including both the measures already taken in response to those requirements and the problems in need of a solution regarding enforcement.

However, the close relation holding between the state of affairs above outlined and the development of High Speed in Spain calls for a preliminary allusion to the implementation of the first Spanish high-speed line endowed with international gauge.
